These Terms of Use govern your use of SimplySit: Meditation Timer, referred to here as “SimplySit” or “the app.” SimplySit is provided by Mythgate. By downloading or using the app, you agree to these terms.
Using SimplySit
SimplySit gives you a personal, limited, revocable, non-transferable license to use the app on Apple devices that you own or control, subject to these terms and Apple’s usage rules. You may use the app only for lawful, personal, and non-commercial purposes.
Apple’s Standard Licensed Application End User License Agreement also applies. If these terms conflict with Apple’s required license terms, Apple’s terms control to the extent of the conflict.
What the app provides
SimplySit is a meditation timer and personal-practice tool. It provides timed sits, optional markers and sound Layers, skippable Feeling check-ins, local history, streak information, reminders, and themes earned through practice.
Features may change as the app improves. We will not intentionally remove paid access during an active subscription without providing a reasonable replacement, refund path, or notice when required by law.
First sit and subscriptions
Your first completed sit is available without a subscription. Continued access after that first sit requires an active SimplySit subscription.
The launch subscription options and current US prices are:
- Weekly: $2.99 per week;
- Monthly: $6.99 per month; and
- Annual: $39.99 per year.
Prices may vary by country, currency, tax, and future App Store pricing changes. The price and billing period shown by Apple at confirmation are the terms of your purchase.
Eligible 7-day trials
Weekly, monthly, and annual subscriptions may include a 7-day introductory free trial for eligible customers. Apple determines trial eligibility. If Apple shows a trial at confirmation, you will not be charged until the trial ends. If Apple does not show a trial, the subscription price is charged when you confirm the purchase.
Unless you cancel at least 24 hours before a trial ends, the subscription automatically converts to the selected paid plan. Trial availability can vary based on your prior subscriptions and Apple’s rules.
Renewal and billing
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Apple charges your Apple ID account at purchase or trial end and within 24 hours before each renewal. Mythgate does not directly collect or store your payment-card details.
Canceling a subscription
Manage or cancel through your Apple ID subscription settings. Cancellation takes effect at the end of the current paid period. Deleting SimplySit does not cancel a subscription. Except where required by law, refunds are handled by Apple under App Store policies.
Restoring purchases
Use Restore Purchases in SimplySit to recover an active subscription associated with your Apple ID. Restoration requires an App Store connection and may rely on RevenueCat to confirm the current entitlement.
Your local data
Sits, Feelings, settings, history, and theme progress are stored locally on your iPhone. They are not linked to a SimplySit account or synced through an app cloud service. You are responsible for device access and for understanding that deleting the app removes this local practice data.
Not medical or mental-health care
SimplySit is not a medical device and does not provide diagnosis, treatment, therapy, crisis intervention, or medical advice. Meditation may not be appropriate for every person or situation. Stop using the app and seek qualified professional help if you experience distress or have concerns about your health.
Do not use SimplySit for an emergency. Contact local emergency services or an appropriate crisis service if you or someone else may be in immediate danger.
Audio and app content
The app’s software, visual design, sounds, text, and other content are owned by Mythgate or used under license. You may use them only as part of SimplySit for personal practice. You may not extract, copy, redistribute, sell, reverse engineer, or create a competing sound library from app content except where applicable law expressly permits it.
Prohibited use
You may not misuse the app, interfere with its operation, attempt unauthorized access, evade subscription controls, use the app to violate another person’s rights, or use it in a way that violates law.
Availability and interruptions
We work to make timing and audio dependable, including while an iPhone is locked. Device settings, operating-system behavior, phone calls, audio-route changes, hardware, and other factors can affect operation. Do not rely on SimplySit as an alarm, safety system, medical tool, or other time-critical service.
Disclaimer
To the maximum extent permitted by law, SimplySit is provided “as is” and “as available.” Mythgate disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
Limitation of liability
To the maximum extent permitted by law, Mythgate will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or opportunity arising from your use of SimplySit. Where liability cannot be excluded, Mythgate’s total liability will not exceed the amount you paid for SimplySit during the 12 months before the event giving rise to the claim.
Termination
You may stop using the app at any time. Mythgate may suspend or terminate access if you materially violate these terms, subject to applicable law and Apple’s purchase rules. Terms that by their nature should continue after termination will remain in effect.
Apple App Store terms
SimplySit is distributed through Apple's App Store, and the following applies to your use of the app on Apple devices. These terms are an agreement between you and Mythgate only, not with Apple. Apple has no obligation to provide maintenance or support for SimplySit. In the event of any failure of the app to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price for the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
Mythgate, not Apple, is responsible for addressing any claims relating to the app or your use of it, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar laws. Mythgate, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party claim that the app or your use of it infringes a third party's intellectual property rights.
You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. You agree to comply with applicable third-party terms when using the app.
Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and upon your acceptance, Apple has the right to enforce these terms against you as a third-party beneficiary.
Changes to these terms
We may update these terms when the app, subscriptions, or legal requirements change. The effective date at the top identifies the current version. Continued use after an update means you accept the revised terms where permitted by law.
Governing law
These terms are governed by the laws applicable where Mythgate operates, without regard to conflict-of-law rules, except that mandatory consumer protections in your home jurisdiction remain available to you.
